Family Law, dealing with the family-related issues, is a law branch which is included in the scope of civil law.
Major subjects of Family Law are betrothing, conditions and provisions of the marriage, conditions and consequences of divorce, community property, family house, paternity, child adoption, guardianship, child support payment, ward, tutorship, legal consultancy, alimony. Although women rights and child rights constitute an area of investigation independently, they fall into concern area of family law.
Recorded or unrecorded partnerships are also contained in the field of family law. Unrecorded partnership is not enacted by Turkish law. There is no right that can be connected to extramarital partnership, however, the child benefit from equal rights whether they are born out of wedlock or not.
The issues that are considered under the scope of women rights or child rights such as family violence, surrogacy, artificial insemination, child abuse and kidnaping are governed peculiarly by both international agreements and domestic national law.
Under family law, the disputes that are associated with the matters governed by Turkish Civil Law and by other special laws are heard in family courts. Additionally, for the assignment of the family court judges, the qualification of those judges, whether they have expertise in family law and whether they are married or not, are taken into consideration, and the persons who bears these qualifications are preferred.
